If you are not satisfied with your SweetCheeks Cellulite Massage Mat purchased directly from www.sweetcheeksproducts.com, you may return the item within 30 days from the date of purchase for a full refund, minus any shipping and handling costs. Returns must be in good condition in the original box and case with a tracking number for full credit upon receipt. Contact email@example.com. If purchased from another retailer or website, please contact them directly for information on their return policy.
SweetCheeks Products, Inc. Limited Warranty for SweetCheeks Cellulite Massage Mat
This Limited Warranty (the “Warranty" or “Limited Warranty") is issued by SweetCheeks Products, Inc. ('the Company') to the original retail purchaser ('Purchaser') of the SweetCheeks Cellulite Massage Mat (the 'Product').
This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state in the U.S. or province to province in Canada.
1. WHO AND WHAT IS COVERED BY THIS LIMITED WARRANTY?
The Company warrants to Purchaser that the Product will be free of defects in workmanship or material, subject to the terms of this document. However, slight material differences or color imperfections due to variations in the manufacturing process shall not be considered defective as its functionality shall be unaffected.
2. HOW LONG WILL THIS WARRANTY LAST?
This Limited Warranty will last and be in effect during the thirty (30) days immediately following the date Purchaser purchased the Product.
3. WHAT DOES PURCHASER HAVE TO DO TO GET WARRANTY SERVICE?
Purchaser must take the following 3 steps to obtain warranty service:
a. Register the Product. Purchaser must register the Product with the Company within the first fifteen (15) days following the date Purchaser purchased the Product. Failure to register the Product will make the Product ineligible for warranty service from the Company.This registration requirement does not apply to residents of any state where this registration requirement is prohibited by state law. Register Purchaser's name, mailing or email addresses, the Product's batch number (on the back of product), and the date of purchase (on Purchaser’s receipt).
b. In the event of a covered defect in Product, notify the Company by phone, email or mail within thirty days of purchase by Purchaser. If Purchaser discovers a covered defect in material or workmanship, Purchaser must notify the Company about the problem and obtain shipping instructions from the Company before returning Product. Contact the Company by phone, email or mail. Be prepared to define a brief description of the defect and how Purchaser discovered the defect.
c. Send the Product back to the Company per the Company’s instructions. Once the Company receives Purchaser's notification for warranty service, the Company will provide Purchaser with a return authorization number and instructions on how to return Purchaser's product. Purchaser must follow the shipping instructions once Purchaser receives them. Purchaser must pay all shipping charges to return the Product to the Company. Purchaser will bear the total risk of loss until the Product is received by the Company.
4. WHAT WILL THE COMPANY DO IF PURCHASER DISCOVERS A DEFECT?
During the applicable warranty period, provided the Product is returned in accordance with the terms of this Limited Warranty, the Company will replace the Product and refund the return product shipping cost in full. All returned Products shall become the property of the Company. New replaced Products will be subject to the terms of this Limited Warranty. The Limited Warranty period is not extended if the Product is replaced. The Limited Warranty period expires at the end of thirty days from the date of the original purchase of the Product. If the Company deems that any returned Product is not found to have a defect, the original Product will be returned to the Purchaser at Purchaser’s expense and no refund to the customer for any returned shipping costs incurred will be given.
5. WHAT IS NOT COVERED BY THIS LIMITED WARRANTY?
This Limited Warranty is conditioned upon proper use of Product by the end User. This Limited Warranty does not cover: (a) defects or damage resulting from accident, misuse, abnormal use, abnormal conditions, improper storage, exposure to sand, dirt, neglect, unusual physical stress or immersion (full or partial) in corrosive liquid; (b) scratches, dents and cosmetic damage; (c) defects or damage resulting from excessive force; (d) Product that has the batch number removed, defaced, damaged, altered or made illegible; (e) ordinary wear and tear; (f) defects or damage resulting from the use of Product in conjunction or connection with accessories, products, or ancillary/peripheral equipment (microwave, freezer) not approved nor furnished by the Company; (g) defects or damage resulting from improper use or maintenance; (h) defects or damage resulting from external causes such as collision with an object, fire, flooding, dirt, windstorm, lightning, earthquake, exposure to weather conditions, theft, or improper use; or (I) Product used or purchased outside the areas where the Company sells or authorizes the sale of the Product.
6. LIMITATION OF LIABILITY AND DISCLAIMERS
THIS LIMITED WARRANTY IS PROVIDED IN LIEU OF ANY AND ALL EXPRESS WARRANTIES. ALL IMPLIED WARRANTIES, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THE WARRANTY PERIOD AND NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WILL APPLY AFTER SUCH PERIOD. SOME STATES (IN THE U.S.) OR PROVINCES (IN CANADA) DO NOT ALLOW LIMITATIONS ON THE DURATION OF AN IMPLIED WARRANTY, SO THE ABOVE LIMITATION MAY NOT APPLY TO PURCHASER’S WHO RESIDE IN SUCH STATE OR PROVINCE. THE COMPANY’S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN THE PRODUCT IS LIMITED TO THE TERMS SET FORTH IN THIS LIMITED WARRANTY. THE PRECEDING LIMITED WARRANTY CONSTITUTES THE COMPANY’S ONLY OBLIGATION TO PURCHASER AND REPRESENTS PURCHASE'S EXCLUSIVE REMEDY AGAINST IT. IN NO EVENT WILL THE COMPANY BE LIABLE FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT OR FOR, WITHOUT LIMITATION, COMMERCIAL LOSS OF ANY SORT; LOSS OF USE, TIME, REPUTATION, OPPORTUNITY, GOODWILL, PROFITS OR SAVINGS; INCONVENIENCE; INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; OR DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT. SOME STATES (IN THE U.S.) OR PROVINCES (IN CANADA DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE DISCLAIMER OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO PURCHASERS IN THOSE STATES AND PROVINCES.
No person or entity is authorized to give any other warranty or to assume any other obligation on behalf of the Company. Any provision of this Limited Warranty prohibited or unenforceable in any jurisdiction shall be ineffective only to the extent of such prohibition and shall not invalidate any of the remaining provisions of this Limited Warranty. THIS WARRANTY IS NOT TRANSFERABLE.
7. GOVERNING LAW
This Limited Warranty will be governed and construed in accordance with the law of the State of Texas, without regard to Texas’ conflict of law rules. PURCHASER AGREES THAT ANY DISPUTES ARISING OUT OF THE PURCHASE OF OR USE OF THE PRODUCT WILL BE DECIDED BY BINDING ARBITRATION. PURCHASER ACKNOWLEDGES AND AGREES THAT PURCHASER WILL NOT FILE A CLAIM AGAINST SWEETCHEEKS IN ANY COURT IN ANY JURISDICTION. AND SPECIFICALLY WAIVES TRIAL BY JUDGE AND/OR JURY.
